Fenwick has updated its privacy policy to ensure that it is accurate, relevant and is expressed as clearly as possible.

We have defined below the key terms that we use in this policy.

  • App” means any software written by Fenwick and provided to You for use in your Dynamics NAV or Dynamics 365 Business Central, or other business system
  • Data” means any data provided by You or with Your authority on our Website
  • You” and “Your” means the user of the website, support, or a subscriber to our Apps
  • Website” means the fenwick.com.au website, and any subdomains

By accessing our Website or purchasing our Apps, You consent to the terms of this Policy and agree to be bound by it, and by the terms in our License Agreement.

Collection of Your Personal Information

To provide You with Apps for your Dynamics 365 Business Central system and service on our Website, we may need to collect Data about a company or an individual. That Data can include personal information. “Personal information” is information about an identifiable individual, it may include (but is not limited to) information such as the individual’s name, email address, telephone number, bank account details, taxation details, and financial information.

We may collect personal information directly from You when You:

  • register to purchase an App;
  • use an App;
  • post a comment on an Article or Blog Post;
  • post a comment on our social media accounts;
  • provide feedback for an App;
  • contact our support team;
  • visit our Website.

You can always choose not to provide Your personal information to us, but it may mean that we are unable to provide You with an App, or support You in the use of our software or Website.

We may also collect information from You about someone else. If You provide us with personal information about someone else, You must ensure that You are authorised to disclose that information to us. This means that You must take reasonable steps to ensure the individual concerned is aware of and consents to this Policy and that they understand:

  • that their personal information is being collected;
  • the purposes for which that information is being collected;
  • the intended recipients of that information;
  • their right to obtain access to that information;
  • our identity;
  • how to contact us.

Where requested to do so by us, You must also assist us with any requests by the individual to access or update the personal information You have collected from them and provided to us.

Use of Your Personal Information

We collect Your personal information for limited purposes, so we can provide you with Apps, and related support services. We may use Your personal information to:

  • verify Your identity;
  • communicate with You, and to notify You of new or changed services;
  • carry out marketing or training related to our service offerings, but not those provided by third-parties;
  • assist with the resolution of technical support issues or other issues relating to our Apps;
  • comply with required law.

By providing us with Your information, You consent to Your information being collected, held, and used in this way and for any other use specifically authorised by You.

You must keep Your password safe. You should notify us as soon as possible of any breach or misuse of Your password and change Your password immediately if any breach occurs.

Storage of Your Personal Information

We store our operational data in Australia. If you are not an Australian resident, this means your information will be transferred to Australia. We ensure that the required level of security is in place to transfer your data to our servers securely. Should any breach occur we will notify You immediately.

We will collect, but not hold, Credit Card information to collect payment for our Apps. Your Credit Card information will be authenticated and stored using a Third-Party Service from Stripe, who will provide us with a secure token. We will only hold your information while it is necessary to do so. This means that some payment information will be held for several years for taxation purposes, even if you discontinue the use of our Apps or Website.

Disclosure of Your Personal Information

We will not disclose your Personal Information for any reason outside the terms of this agreement without your express consent. We may only disclose your information without Your consent if required to do so by law.

Access to Your Personal Information

You may request access to the information we hold about You at any time by submitting a request to our Data Privacy Officer (DPO) at privacy@fenwick.com.au.

We will process this request as soon as possible and provide You with the required information if we are permitted to do so by law.

Cookies

To provide you with an improved website shopping cart experience, we use Cookies. A Cookie is a small file that is stored on your hard drive which may include an anonymous and unique identifier. You are able to refuse the use of Cookies through your internet browser settings however this may render parts of our Website unusable.

We also use cookies to track overall Website usage, and track and report on your interaction with our Website. This information is anonymised and reported on with Google Analytics. We have enabled advertising tracking from Google Ads to assess the performance of our Ads campaigns. You can opt-out of these features through Ads Settings. We do not otherwise sell or distribute any personal information collected with Cookies to any third-party or partner.

Email Communication

You can opt-out of email communication at any time. Please send a request to: privacy@fenwick.com.au and we will remove you from our mailing list. We will continue to email You account information (i.e. invoices and statements).

Complaints

If You wish to make a complaint about how we have handed your Personal Information, please email us at privacy@fenwick.com.au with details of Your complaint.

We will provide a response within ten (10) business days and investigate and resolve your issue as soon as practical.

Updates

We may update this policy from time to time. All updates, with identified changes, will be placed on our Website. If you have an active App subscription, You will be notified of major changes by email, unless you have opted out of email communication. Your continued use of Apps and the Website will be deemed as acceptance to any amendments to the Policy.
